Subscription Agreement

This Subscription Agreement governs your purchase and use of paid plans for the Smart Lister Service operated by Seiber Solutions LLC (“we”, “us”, “our”). This Agreement is part of, and incorporated by reference into, the Smart Lister Terms of Service.

Plain-English Summary

Paid plans auto-renew until you cancel. You can cancel anytime from the Profile tab in the app and keep your access until the end of the period you've paid for. Subscription fees are non-refundable for partial periods. Monthly subscribers earn a one-time bonus of 25 extra listings after their second successful monthly payment.

1. Plans and Pricing

We offer monthly and annual subscription plans with different listing allowances, AI usage caps, and feature sets. The current plans and prices are displayed in the app and on smartlister.app. Prices are shown in U.S. dollars and exclude any applicable taxes, which will be added at checkout.

2. Auto-Renewal

Your subscription renews automatically. When you subscribe to a monthly or annual plan, you authorize us (through our payment processor, Stripe) to charge your payment method the then-current plan price, plus applicable taxes, at the start of each new billing period, until you cancel. Monthly plans renew every month; annual plans renew every twelve (12) months.

We will continue charging your payment method on file until you cancel. If your payment method fails, we may retry the charge a limited number of times and may pause or downgrade your plan if it remains unpaid.

3. Loyalty Bonus (Monthly Subscribers Only)

As a thank-you for committing to a monthly plan, you will receive a one-time bonus of twenty-five (25) additional listings credited to your account after your first full month of continuous, paid monthly subscription. The bonus is:

4. Cancellation

You may cancel your subscription at any time from the Profile tab in the app or by emailing support@smartlister.app. Cancellation takes effect at the end of your then-current paid billing period. You will continue to have access to the paid features through the end of that period, and you will not be charged again unless you re-subscribe.

5. Refunds

Subscription fees are non-refundable, including for partial billing periods, unused listings, time when the Service is degraded due to events outside our reasonable control (such as third-party API outages), or when you cancel mid-period. Listing-pack and one-time purchases are likewise non-refundable once delivered.

Limited courtesy refund. As a goodwill exception, we may, at our sole discretion, issue a one-time full refund for your first paid month if you contact support@smartlister.app within seven (7) days of that first charge and have not used a meaningful portion of the plan’s resources. This is a courtesy and not a contractual right.

Where applicable mandatory consumer-protection law requires a refund or “cooling-off” period that goes beyond this Agreement, those rights are not waived.

6. Price Changes

We may change our prices from time to time. If we increase the price of your plan, we will give you at least thirty (30) days’ advance notice by in-app message or email. The new price will apply to your next renewal after the notice period. You may cancel before the next renewal to avoid the new price.

7. Promotions and Coupons

We may offer promotional codes, partner discounts, or limited-time pricing. Promotions are subject to additional terms shown at the time of the offer, may be revoked at any time before redemption, and cannot be combined unless we expressly say so.

8. Taxes

Prices do not include sales, use, value-added, or similar taxes. You are responsible for all applicable taxes, which Stripe may collect on our behalf at checkout based on your billing address.

9. Chargebacks

If you initiate a chargeback or payment dispute without first contacting us at support@smartlister.app to attempt to resolve the issue, we may immediately suspend or terminate your account and forfeit any pending loyalty bonus or unused balance.

10. Free Tier

We may make a free tier available with limited functionality and listing volume. Free-tier usage is not a subscription and is not subject to this Agreement except where this Agreement expressly says so. Free-tier features may change or be discontinued at any time.

11. Termination by Us

We may suspend, downgrade, or terminate your paid plan if (a) your payment fails and is not cured, (b) you breach the Terms of Service, (c) you initiate a chargeback that we determine to be invalid, or (d) we reasonably believe your activity is fraudulent or harmful to the Service or its users.

12. Changes to This Agreement

We may update this Subscription Agreement from time to time. If a change is material, we will give you reasonable advance notice (such as an in-app notice or email). Your continued use of the paid Service after the effective date constitutes acceptance.
